Fanslym Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legal agreement between you ("User") and Fanslym ("we", "our", "the Platform") regarding the use of the Fanslym mobile application, website, and services.

By registering, accessing, or using Fanslym, you agree to comply with these Terms. If you do not agree, you must not use the Platform.

2. Service description

Fanslym is a global amateur sports social network that allows you to:

  • Create profiles as fan, athlete, or team.
  • Organize and participate in amateur sports events.
  • Manage teams, players, and competitions.
  • Publish sports content, interact through comments, reactions, and messages.
  • Discover events, teams, and users in the community.

Fanslym reserves the right to modify, suspend, or discontinue any feature at any time, with or without prior notice.

3. Eligibility

To use Fanslym you represent and warrant that:

  • You are at least 18 years old at the time of registration.
  • You have legal capacity to enter into binding contracts in your jurisdiction.
  • You have not been previously suspended or banned from the Platform.
  • You will not use the Platform in violation of applicable laws.

If we detect that a user has provided false information about age or identity, we will suspend and delete the account.

4. User account

4.1 Registration

To create an account you must provide truthful, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your password and all activities performed from your account.

4.2 Account types

  • Fan: individual users who consume content, follow teams and athletes.
  • Athlete: individual amateur athletes.
  • Team: accounts managed by a responsible adult user ("owner") on behalf of a club, team, or sports organization. The owner is responsible for information published and actions performed by their team.

4.3 Account security

Notify security@fanslym.com immediately if you suspect unauthorized use of your account. Fanslym will not be responsible for losses resulting from unauthorized use if you fail to notify us promptly.

5. Acceptable use

You agree not to:

  • Publish illegal, violent, sexually explicit, discriminatory, defamatory content, or content that promotes illegal activities.
  • Harass, intimidate, threaten, or abuse other users.
  • Impersonate another person, team, or organization.
  • Use the Platform for spam, unauthorized advertising, or fraudulent schemes.
  • Collect information from other users without their consent.
  • Use bots, scrapers, or other automated tools to access the Platform.
  • Attempt unauthorized access to other accounts, systems, or data.
  • Interfere with normal Platform operation.
  • Violate third-party intellectual property rights.
  • Publish private information of third parties without their consent.

Fanslym reserves the right to remove content, suspend, or terminate accounts that violate these rules, at our discretion.

6. User content

6.1 Ownership

You retain all rights over the content you publish on Fanslym (posts, photos, videos, comments, event information).

6.2 License to Fanslym

By publishing content on the Platform, you grant Fanslym a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, store, display, reproduce, modify, and distribute such content for the purpose of operating, promoting, and improving the Platform.

This license terminates when you delete the content, except to the extent that content has been shared with third parties who have not deleted it, or when retention is necessary for legal reasons.

6.3 Responsibility

You are solely responsible for the content you publish. You represent and warrant that you have the necessary rights to publish it and that it does not infringe third-party rights.

6.4 Sports event content

By organizing or participating in events, you accept that event information (title, description, date, location, results) may be publicly visible to promote the event and the sports community.

7. Platform-specific rules

7.1 Sports events

  • Organizers are responsible for the accuracy of published information.
  • Reported results require cross-confirmation between organizer and participating team.
  • Event cancellation must be performed with valid reason and notification to accepted participants.

7.2 Teams

  • The owner of a team account is a responsible adult user for its members and actions.
  • Team members are individual users who agree to be part of the roster.
  • Fanslym does not intervene in internal disputes between team members.

7.3 Messages

  • Messages between users are private except for conversation participants.
  • Fanslym may access messages in cases of abuse reports, security investigations, or valid legal requirements.

8. Reports and moderation

Users may report content or accounts that violate these Terms using the reporting function within the Platform.

Fanslym will review reports and may take actions including, but not limited to:

  • Warning the reported user.
  • Removing reported content.
  • Temporary account suspension.
  • Permanent account termination.

Moderation decisions are at Fanslym's discretion and are final, although users may appeal by writing to support@fanslym.com.

9. Fanslym intellectual property

The Platform, including its code, design, brand, logos, texts, and features, is owned by Fanslym and protected by intellectual property laws. You do not acquire any rights over these elements through use of the Platform.

The name "Fanslym" and associated logos are trademarks (or in process of registration) of Fanslym. Their use without express authorization is prohibited.

10. Third-party services

Fanslym may integrate third-party services (for example, Sign in with Apple, future payment processors). The use of these services is subject to the terms and policies of their respective providers. Fanslym is not responsible for the practices of these third parties.

11. Future payments and subscriptions

Fanslym is currently free. In the future we may offer paid features or subscriptions. In such a case, we will publish specific terms applicable to those features with reasonable advance notice. Payments would be processed by external providers (for example, Stripe, Bluesnap, or others), subject to their own terms.

12. Termination

12.1 Termination by user

You may delete your account at any time from the app settings or by writing to privacy@fanslym.com.

12.2 Termination by Fanslym

Fanslym may suspend or terminate your account if:

  • You violate these Terms.
  • You provide false information.
  • You use the Platform illegally or abusively.
  • Your account remains inactive for extended periods.

In case of termination for serious violation, there will be no refunds if charges apply.

12.3 Effects of termination

Upon termination of your account:

  • You will lose access to your content and Platform features.
  • Your information will be deleted as described in our Privacy Policy.
  • Certain provisions of these Terms that by their nature must survive (intellectual property, indemnifications, limitations of liability, applicable law) will remain in effect.

13. Disclaimer of warranties

Fanslym is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, continuous availability, or absence of errors.

We do not warrant that:

  • The Platform will be uninterruptedly available.
  • Results obtained will be accurate or reliable.
  • Defects will be corrected.
  • The Platform will be free of viruses or harmful components.

14. Limitation of liability

To the maximum extent permitted by applicable law:

  • Fanslym shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, reputation, or other intangible losses.
  • Fanslym shall not be liable for conduct or content of other users, including users who interact with you on the Platform or in sports events organized through it.
  • Fanslym is not the organizer of sports events published by its users. Organizers are responsible for the safety, logistics, permits, and legal compliance of their events.
  • Fanslym's total liability for any claim related to these Terms or the Platform shall not exceed the amount you have paid to Fanslym in the 12 months prior to the event giving rise to the claim, or USD $100, whichever is less.

15. Indemnification

You agree to indemnify and hold harmless Fanslym, its directors, employees, and agents from any claim, demand, damage, loss, or expense (including reasonable legal fees) arising from:

  • Your use of the Platform.
  • Your violation of these Terms.
  • Your violation of third-party rights.
  • The content you publish.

16. Modifications to Terms

Fanslym may modify these Terms occasionally. Significant changes will be notified through a visible notice on the Platform or by email with at least 15 days advance notice. Continued use of Fanslym after the effective date constitutes acceptance of the new Terms.

If you do not agree with the modifications, you must stop using the Platform and may delete your account.

17. Applicable law and dispute resolution

17.1 Applicable law

These Terms are governed by the laws of the Dominican Republic, without giving effect to conflict of laws principles.

17.2 Dispute resolution

Before initiating any legal action, the parties agree to attempt to resolve disputes in good faith through direct communication. Any unresolved dispute will be submitted to the competent courts of Santo Domingo, Dominican Republic.

17.3 Class action waiver

To the maximum extent permitted by applicable law, you waive the right to participate in class actions against Fanslym. Any claim must be filed individually.

18. General provisions

18.1 Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Fanslym regarding the use of the Platform.

18.2 Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full effect.

18.3 No waiver

Fanslym's failure to exercise a right provided in these Terms does not constitute a waiver of that right.

18.4 Assignment

You may not assign these Terms without our prior written consent. Fanslym may freely assign them to subsidiaries, successors, or in case of corporate reorganization.

18.5 Communications

Any formal legal notice to Fanslym must be sent to legal@fanslym.com.
